HeyBodhi Terms of Service:
Please read carefully. By clicking “I agree,” creating an account, or using HeyBodhi’s websites, apps, chat or voice features (the “Service”), you agree to these Terms of Service (the “Terms”) and our Privacy Policy.

Who we are & what we do
HeyBodhi is an AI-powered coaching and professional development tool for K-12 educators. We provide reflective prompts, strategies, activities (e.g., breathwork, journaling), and just-in-time support. We do not provide therapy, diagnosis, or medical care.
2. Medical disclaimer; crisis notice
No medical/mental health services. HeyBodhi provides coaching and educational information only. It is not therapy, counseling, psychotherapy, or medical care.
No emergencies. The Service is not monitored for emergencies. If you are in crisis or considering self-harm or harm to others, call 911 or 988 (Suicide & Crisis Lifeline) immediately.
Always exercise professional judgment and seek qualified help when appropriate.
3. AI transparency
When you use chat/voice, you are interacting with artificial intelligence, not a human. We label AI output in-product. We implement safety measures, but AI can make mistakes or misinterpret context.
4. Eligibility & accounts
The Service is intended for adults (18+). It is not for students/minors.
You must provide accurate registration info and keep credentials confidential. You are responsible for activity under your account.
We may suspend/terminate accounts for violations or risk to users/the Service.
5. School pilots & educator use
If you access the Service through a school or district (a “School Customer”), your use is subject to these Terms and our Privacy Policy (available at https://www.heybodhi.ai/english-privacy-policy). Our Privacy Policy explains how we protect your data and ensure that School Customers only receive de-identified or aggregated reports (for example, participation and trend data). No School or administrator has access to your individual chat content or GAD-7 responses without your explicit consent.
6. Privacy; FERPA/SOPIPA alignment; COPPA
Our Privacy Policy explains what we collect and how we use it, including chat/voice content, usage analytics, and optional well-being assessments (e.g., GAD-7).
FERPA. If any student personal information is incidentally disclosed in educator use, we act as a “school official” with a legitimate educational interest and will use such information only to provide the Service to the School Customer, and not disclose it except as permitted by law or the School.
SOPIPA/State student privacy. We do not sell personal information, and we do not use personal information for targeted advertising. We delete or return School-controlled data upon request consistent with law/contract.
COPPA. The Service is not directed to children under 13 and is not student-facing.
7. Vendor disclosures; model training
We use third-party providers (e.g., cloud hosting and AI model APIs) to operate the Service. We implement safeguards and limit use of personal data to Service delivery. We do not permit third-party model training on your personal data. See the Privacy Policy for current vendor details and retention periods.
8. License; user content
License to you. Subject to these Terms, we grant you a limited, revocable, non-transferable, non-sublicensable license to use the Service for your personal and professional development.
Content. You retain rights to your personal data. You grant HeyBodhi a non-exclusive license to use your content to operate, secure, support, and improve the Service (including quality, safety, and feature improvement), and to create de-identified analytics and research insights. You may request deletion of your personal data as described in the Privacy Policy.
Feedback. If you send ideas or suggestions, you allow us to use them without restriction or compensation.
9. Acceptable use
You agree not to: (i) use the Service for unlawful, harmful, or discriminatory purposes; (ii) probe or disrupt the Service or bypass safety features; (iii) share others’ personal data without permission; (iv) attempt to make the AI produce unsafe content or present AI output as human advice; (v) reverse engineer or scrape; (vi) use the Service with students/minors.
10. Subscriptions & pilots
Pilots. Unless otherwise stated, pilots are free, time-limited, “as-is,” and may be ended by either party on notice.
Paid plans. If you purchase a subscription, it will auto-renew unless you cancel in your account settings. Taxes, refund, and cancellation terms appear at checkout or in your order confirmation.
11. Service changes; communications
We may modify or discontinue parts of the Service. We may send you transactional emails or in-app notices (e.g., feature updates, policy updates). You consent to electronic communications.
12. Communications & email practices
We may send you periodic emails related to product updates, account activity, or educational resources. You can unsubscribe at any time using the link in those messages.
We do not sell, rent, or share your email address with third parties for marketing purposes. We may share your contact information only with vendors who help us send these communications, under confidentiality agreements.
13. Warranty disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” HEYBODHI AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT ERRORS WILL BE CORRECTED.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYBODHI, ITS AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA, PERSONAL INJURY, OR EMOTIONAL DISTRESS). CAP: FOR FREE PILOTS OR FREE USE, OUR TOTAL LIABILITY IS $100. FOR PAID USERS, OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNTS YOU PAID TO HEYBODHI IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITS—IF SO, THOSE LIMITS APPLY TO THE FULLEST EXTENT ALLOWED.
15. Indemnity
You will indemnify and hold harmless HeyBodhi from third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (i) your breach of these Terms; (ii) your misuse of the Service; or (iii) your content that infringes or violates others’ rights or law.
16. Disputes; arbitration (individual users only)
This Section applies to individual users, not School Customers bound by a separate agreement. You and HeyBodhi agree to binding arbitration on an individual basis for any dispute arising out of or relating to these Terms or the Service, except for small-claims matters or claims seeking injunctive relief for IP or security. No class actions or representative proceedings.
Rules & forum. Administered by JAMS under its applicable rules. Location: [SAN DIEGO COUNTY, CA] (or video).
Opt-out. You may opt-out of arbitration within 30 days of first accepting these Terms by emailing [LEGAL@HEYBODHI.COM ] with your name and the statement “I opt out of arbitration.”
Governing law. Delaware law (without conflict rules) governs, except that the FAA governs arbitration issues. If arbitration is unenforceable, exclusive venue is state/federal courts in [SAN DIEGO COUNTY, CA], and both parties waive jury trial.
17. Term; termination; survival
You may stop using the Service any time. We may suspend or terminate access for any violation or risk to users/security. Sections that by nature should survive (e.g., privacy commitments, disclaimers, limits, IP, disputes) continue after termination.
18. Changes to these Terms
We may update these Terms. If we make material changes, we will notify you (e.g., in-app or email). Continued use after the effective date means you accept the updated Terms.
19. Intellectual property
HeyBodhi, our logos, and all Service content (excluding your inputs) are owned by us or our licensors and protected by IP laws. No rights are granted except as stated.
